Snowstorm prevents judge from making trip to Weyburn

Fresh snow whipped up by the wind prevented the regular docket of provincial court to go ahead in Weyburn on Monday morning.

The presiding judge out of Moose Jaw provincial court, Judge M. Irwin, phoned court officials to indicate he wasn't able to make the 90-minute trip to Weyburn. The Crown prosecutor, Liz Krogan, made the trip from Regina only to have all criminal matters adjourned to other dates in November.

On his way out of court, Weyburn lawyer Greg Bobbitt commented, "If we had a resident judge, this wouldn't have happened."

Weyburn's resident judge, Claude Fafard, has been on an extended sick leave since last year, and provincial court has been administered by Moose Jaw since Sept. 1.

Among those making an appearance Monday was Allan Melby, 34, on his third charge of impaired operation of his motorized wheelchair. He asked for the charge to be adjourned to Nov. 27, when he will face trial on his first two charges.

Perry Benning had his charges adjourned to Nov. 13, including a charge of possession of a stolen vehicle of a value over $5,000.

Three people being held in custody were to appear on Monday, including two youths and an adult, Matthew Farney, and all three had their charges adjourned to Nov. 13.

Ryan Englot, 19, also had his charges adjourned to Nov. 13. He faces charges from Oct. 6 of assault, uttering a death threat to two city police officers, resisting arrest, failing to appear in court, plus a ticket for having liquor in a public place.

Christina Schlacter, 25, and her sister Toni, 19, both had their charges adjourned to Nov. 20, along with co-accused Brian Tweedle. Christina faces two charges of assault and a charge of mischief for causing damage to an apartment; Toni has a single assault charge and single mischief charge, as does Tweedle.

Mark Preston appeared on a charge of mischief, and had the matter adjourned to Nov. 27 to be spoken to.
